      On March 18, 2008 at approximately 11:28 pm, Officers of the Salisbury Police Department received a call to respond to the Days Inn Motel on North Salisbury Boulevard for the report of a shooting. Officers also responded to the Peninsula Regional Medical Center to meet with the  victim, who was receiving treatment. Upon meeting with the victim, who was identified as 29 year old David Jesse Hotton of Salisbury, the officers were advised by the victim that the victim had exited from his room at the Days Inn and was walking to the parking lot to meet a friend. The victim was accosted from behind by two (2) suspects, one of which produced a handgun. The suspects became involved in a physical altercation with the victim, then shot the victim one (1) time in the upper left shoulder. The injury was not life threatening and the victim was listed in good condition. This investigation is continuing.

 

     The suspects were described as:

               

1.      Black male, 6’1” to 6’2” tall, medium build, wearing a black hooded sweatshirt,

dark pants, and a face mask

 

2.      Black male, 5’10” to 6’00” tall, medium build, wearing a black hooded sweat-

shirt, dark pants and a green shirt covering the bottom of his face.

     On March 18, 2008 at approximately 1:12 pm, Officers of the Salisbury Police Department were in the area of Mitchell Road in Salisbury when they observed a motor vehicle being operated with a subject on the hood of the vehicle. The officers observed the vehicle stop and the driver of the vehicle exit and approach the subject that had been on the hood.  The driver of the vehicle, listed below, struck the subject several times in the chest area. The officers were able to reach the suspect and place the suspect under arrest. The victim advised the officers that he had been walking in the parking lot of Pemberton Apartments when he observed the vehicle driving toward him. The victim jumped, to avoid the vehicle, and ended up on the hood of the vehicle where he was transported to the Mitchell Road area and the officers became involved. The officers detected an odor of alcohol on the person of the suspect, who was found to be driving while intoxicated. A quantity of alcoholic beverage was also found in the driver’s area of the vehicle.

 

ARRESTED:    Jimmy Lee Smullen, 52 years of age

                         Salisbury, Maryland

 

CHARGES:      First degree assault

                          Second degree assault

                          Driving while Intoxicated

                          Driving under the influence of alcohol

                          Reckless driving

                          Possession of alcohol in a vehicle

                          Hit and Run accident

 

DISPOSITION:   Released to Central Booking
